Previously on One Day at a Time
- Trenyce decided to sue Savannah for custody of Andrew, despite Natasha claiming she may not win
- Chris returned to Twin Peaks at the preliminary hearing to offer his support to Trenyce. He told Trenyce & Daisy that he is a changed man and no longer a womanizer, also revealing that he and Greta had split up

Scene One - The Twin Peaks Court House

Walking into the court room was difficult for Trenyce but she kept moving forward. The entire custody hearing is scheduled for today and she is scared to death about the outcome. She already knows that she may not be successful in regaining custody of Andrew but after the numerous telephone calls for help from Savannah and seeing the chaotic state of Savannah's apartment, she felt like she had no other option but to try to get Andrew back. She owes the boy that much at least.

"I know this may not work," she whispers to herself as she slowly walks into the court room. "But I have to try. If nothing else, I have to try."

"I know you're scared," Chris tells her as he comes up behind her. "But I think you are doing the right thing. And you know that I'm here to support you with this. It's why I came back to town."

Trenyce turns around and sees Chris. "Thank you for coming back here. I know we haven't always gotten along but I feel like Andrew needs all the support he can get right now."

"We are all here to support you and Andrew," Daisy announces as she enters the court room with Vinny next to her. "We won't leave you until this is settled."

Trenyce bites her lower lip hoping that she won't start to cry. "Thank you guys," she says as Natasha opens the court room door.

"Oh good, you're all here," Natasha says as she comes up to them. "Are you ready for this?" she asks Trenyce, who nods her head.

"As ready as I'll ever be," Trenyce replies to her.

"Well, today is the only day the Judge will hear testimonies so it's a big day. I won't be asking big questions but I need you all answer as honestly as you can. None of you will be surprised by the questions," Natasha advises the group, who all nod their head. "If you need to get away for some water, stay close because I'm thinking the testimonies will go quite quickly."

They all pause and look at the court door when it opens and Savannah appears. Trenyce watches her foe as she slowly makes her way to the end of the aisle and has a seat. No words were spoken but the tension was extremely loud in the court room.

Savannah sits in chair and takes a deep breath. She turns her head quickly back to look at Trenyce and her family. She turns back around and shuts her eyes for a moment. "He is my son. They can't take him away from me, they just can't," she whispers to herself as she tries to calm herself down. She only hopes it starts to work.

Andy slowly makes his way up to the stand. He is sworn in and then he sits down. Natasha stands up and looks at him. "Please state your name for the records," she says to Andy.

"Andy Spinnes," he replies to her quickly. "Trenyce and I have been good friends since High School."

"Which means, Mr. Spinnes, you've seen Trenyce with Andrew since he was born?" Natasha asks him.

Andy nods his head. "Yes, I have been. Trenyce never suspected that Andrew wasn't her son. None of us did."

"Having seen Trenyce interact with Andrew since his birth, would you say that Trenyce is a good mother?" Natasha asks him next.

"She's the best mother in the world," he says as he looks over at Trenyce, who smiles at him as she gets tears in her eyes. "She would do anything for that little boy. She loves him more than anything in the world."

"And how was Trenyce after the truth about the baby switch came out?"

"She was devastated, of course," Andy tells the court. "Trenyce gave Andrew to Savannah because she had too. If it was up to her, she would still be raising the child she thought was to be hers for so long."

"Thank you, Mr. Spinnes," Natasha tells him. "I have no further questions."

Josh Levitt, Savannah's lawyer, stands up and fixes his tie and buttons up one of his jacket buttons before he looks at Andy. "You and Ms. Davenport have been more than just friends, isn't that correct Mr. Spinnes?"

Andy gulps. "I'm not sure I understand your question."

"You and Trenyce, you were married once, correct?" Josh asks him next, knowing that Andy and Trenyce have a sorted history.

Andy looks over at Trenyce briefly. "Answer the question Mr. Spinnes," Judge Ross instructions Andy.

"Yes, we were, but…"

"I didn't ask for you for an explanation," Josh interrupts him. "The reason you two got an annulment was because you never really loved Trenyce, correct? You were helping her cover a lie."

"Objection!" Natasha yells standing up from her seat.

"I'm trying to determine character, your honour," Josh says as he looks at the Judge.

"I'll allow it," Judge Ross says back to them as Natasha sits back down.

"Mr. Spinnes?" Josh says as he looks at Andy.

Andy shakes his head. "It was complicated Mr. Levitt. Trenyce was scared that Andrew's father would try to take him away from her, so yes I went along with the lie that I was Andrew's father."

"And in the end, Andrew almost died before the truth came out, correct?"

"Yes, but…"

"No buts, thank you Mr. Spinnes," Josh smiles at him. "No further questions your honour."

Daisy is the next witness that gets sworn in; then she sits down and quickly moves a piece of her hair behind her ear. "I am Daisy Davenport, I am Trenyce's Aunt. She's lived with me since she moved to Twin Peaks."

"And, just for the record, can you also state your occupation, please," Natasha tells Daisy.

"I am the mayor of Twin Peaks," Daisy replies with some pride in her voice.

"I'm going to ask you the same sort of questions that I asked Mr. Spinnes," Natasha tells her. "Before the truth about this baby switch came out, how was Trenyce as a mother?"

"Oh, she was absolutely wonderful with Andrew. They have a bond that will never be broken, even now that he is with Savannah. The first few years of a child's life … the ones that raise him from that stage will always be in his heart. No paternity test will ever change that. Nor should it."

"I also have to ask you because I know Mr. Levitt will bring this up," Natasha says looking at Daisy. "Chris Michaels was considered to be Andrew's father?"

"That's correct."

"But you were married to him at the time, is that right?" Natasha asks her, knowing that she is going to be digging into some personal moments for Daisy.

"Yes. Chris had an affair with my niece. It's water under the bridge. Everyone made a mistake. But none of us, myself included, have any regrets because the affair brought Andrew into this world; or so we believed it was Andrew."

"In your opinion, do you think Andrew would be better off with Trenyce?" Natasha asks her.

Daisy shakes her head. "Honestly," she begins to say. "I have no idea. I know that Andrew is confused right now because he thinks that he can't be with his family. But I also understand that Savannah is his biological mother. This entire situation is just a big mess."

"Thank you for your honesty," Natasha replies to her. "No further questions."

"Let me get this straight," Josh begins to say as he stands up. "Your husband and your niece slept together while they were living in your house?"

"I've already answered that question," Daisy replies to him.

"Answer it again Ms. Davenport," Josh says with a slight grin on his face.

"Yes."

"No further questions your honour."

"Please state your name for the record," Natasha asks Chris, after he is sworn in and has a seat in the witness stand.

"Christopher Michaels," Chris replies slowly. "I believed I was Andrew's father."

"Correct me if I am wrong, Mr. Michaels, but you only recently came back to town, is that right?" Natasha asks him.

Chris nods back to her. "That's correct."

"Can you explain why this is?"

"I had moved out of Twin Peaks a couple of years ago. I needed to change the kind of man I was. Being away helped me clear my head and change something aspects of myself that needed to be changed."

"How are you feeling now that you're aware of this baby switch?" Natasha asks him.

"I'm shocked, just like everyone else," Chris replies to her. "Trenyce and I, we always believed that little boy was our baby. He is our son. Nothing will ever change that."

"You and Trenyce," Natasha begins to say. "You haven't always seen eye to eye."

"No, we have not," Chris says back to her. "I was livid when I learned that Andrew was my son. She had tried to keep him from me. We have moved on though. I think Andrew would be better left with Trenyce. She's the mother Andrew has always known and loved."

"And now that you're back in town, you'd help Trenyce with Andrew?"

"Of course. Anything Trenyce or Andrew needs, I'm there for them."

"Thank you Mr. Michaels," Natasha says. "No further questions."

"Mr. Michaels," Josh says as he stands up. "How many times did you cheat on your wife?"

"Objection!" Natasha says as she stands up growing frustrated with Josh's tatics.

"Overruled," Judge Ross replies. "Mr. Levitt, you don't have to discredit Mr. Michaels, he's not the one suing for custody."

"Fair enough," Josh replies as he returns his attention to Chris. "When the truth about the baby switch came out, why didn't you come back to town immediately?"

"I didn't know until recently," Chris replies.

"So, let me get this straight Mr. Michaels - you are, in your mind, Andrew's father. The truth that he's not your son comes out and no one in your family decided to pick up the telephone and call you?"

Chris sighs. "Look, Mr. Levitt, when your world is turned upside down you try to cope. Sometimes minor details are overlooked."

"Informing a child's parent is a minor detail now? I don't think I can ask any more questions your honour," Josh says with a chuckle. "It's almost a joke."

"Mr. Levitt," Judge Ross replies with a stern look in his eyes. "That's enough."

Natasha looks over at Trenyce. "Are you sure you're ready?" she whispers to Trenyce, who nods back to her.

"As ready as I will ever be," Trenyce replies to her.

"Okay," Natasha says with a small smile. "You'll be fine."

"Ms. Calimo," Judge Ross says. "Are you ready for your next witness? We don't have all day here."

"Trenyce Davenport," Natasha quickly replies as she stands up. "I call Trenyce Davenport to the stand."

Trenyce stands up and slowly makes her way to the witness stand where she gets sworn in. She sits down and looks at Natasha.

"Trenyce, can you state your name for the record?" Natasha asks her softly.

"Trenyce Davenport," she replies quietly.

"And you're Andrew's mother?"

Trenyce bites her lip. "I believed I was for years," she begins to say to everyone. "But biologically, Savannah is Andrew's mother. I suppose I am the woman that has raised him though, which is why I am here today. I just want what's best for Andrew. I love that little boy so much and he only deserves someone that can raise him properly."

"What makes you think Savannah Pherson won't or isn't a good mother to Andrew?" Natasha asks her as she folds her arms across her chest.

Trenyce sighs and looks at Savannah, whose head is down. "After the truth about the baby switch came out, Savannah took custody of Andrew. It was one of the hardest things I've ever had to do in my life," Trenyce says as she bites her lip again to try to prevent herself from crying. "I struggled with it for many days, many weeks. The missing of Andrew and trying to move forward."

"And then what happened?" Natasha asks her.

A single tear falls from Trenyce's eye. "Savannah started calling me and asking me to come over to her apartment for help."

"Help with what?" Natasha continues her questioning.

"At first it was just Andrew," Trenyce reveals to the court. "He wasn't listening to her. He wasn't eating. He didn't understand why I wasn't there. As soon as I would arrive, he would rush to me and practically beg me to take him home. My heart continued to break every time Savannah asked me for help."

"So why did you continue to go over and help her?"

Trenyce shrugs her shoulders. "Because I love Andrew and I don't want him to suffer. If I can get him to eat and bathe him for Savannah, I would do that. And I would do it all over again."

"What happened the last time you went to Savannah Pherson's apartment?" Natasha asks her next.

Trenyce tries to collect herself before she answers. "The apartment was in a state of chaos. There were dishes everywhere, clothing scattered throughout the apartment, it was just not pleasant. Savannah hadn't bathed in a day or two; so I offered to put Andrew down and let her clean up while I cleaned the house. That's when I got the idea that I should try to save Andrew from Savannah. She obviously can't watch him properly."

"How dare you!" Savannah stands up yelling from her chair. "I was asking you for HELP and you're using that against me!"

"Ms. Pherson!" Judge Ross yells at her as Josh tries to calm Savannah down. "Sit down or I will hold you in contempt."

Once Savannah has calmed down, Natasha returns looking to Trenyce. "Thank you Trenyce, no further questions your honour."

Josh looks over at Savannah before he stands up. "Ms. Davenport, do you love your Aunt Daisy?"

Trenyce looks shocked at him. "Of course I do," she replies to him.

"Yet, you had an affair with her husband?" Josh says next to her.

Trenyce shakes her head. "I was dealing with a lot of anger and grief," Trenyce replies to him.

"It's a yes or no question Ms. Davenport."

"Yes, I did."

"And you claim to love Andrew?"

"I do, more than I can express," Trenyce tells him.

"Well if you love your Aunt but you could sleep with her husband, I'd hate to see what you'd do to Andrew if you claim to love him."

"Objection!" Natasha yells from her chair.

"I have no further questions your honour," Josh replies as Trenyce drops another tear from her eye.

"Please state your name for the record," Josh says to Reese, who has now been sworn in and has taken a seat in the witness stand.

"Reese Wilkins," Reese says slowly to the courts. "Savannah became a close friend of mine when she moved to Twin Peaks."

"Mr. Wilkins, what was your reaction to the news of the baby switch?"

"Like everyone else, I was shocked," Reese admits to Josh. "But I thought that Trenyce did the right thing when she gave Andrew to Savannah. Savannah is Andrew's mother, after all."

"Do you believe that Savannah should be allowed to raise her son?" Josh asks him next.

"Look, I've been friends with Trenyce for many years. Like my partner Andy, I went to high school with her. We've been through a lot together. It's not her fault and it's not Savannah's fault that this happened. Had the baby switch not occurred, Savannah always would have had Andrew, so yes I think she should have the chance to raise Andrew."

"Thank you Mr. Wilkins, no further questions."

Natasha stands up and looks at Reese. She looks at the young man and immediately thinks of Preston, who was Natasha's boss for many years. She knows she is supposed to attack on the stand but she doesn't think she can.

"Mr. Wilkins, I only have one question for you," Natasha says to him. "Do you have any qualifications to make assumptions about who a child should or should not live with?"

Reese shakes his head. "No, I don't."

"No further questions."

"Next witness Mr. Levitt?" Judge Ross asks from his chair in the court room.

"I'd like to call Savannah Pherson," Josh announces as Savannah slowly stands up and moves towards the witness stand. She is sworn in and has a seat in the witness stand. "Please state your name for the record."

"Savannah Pherson," she says slowly in to the microphone.

"Ms. Pherson, you lived in New York for many years, is that correct?" Josh asks her first.

"That's correct," Savannah replies. "I came to Twin Peaks because Dominick Robertson offered me a job at his company Robertson Enterprises. I moved here shortly after."

"Can you explain what happened when you did move here?"

Savannah gulps. "Right away I saw a man that I thought was a man from my past," Savannah explains. "It turns out that the man that I had been dating a few years earlier in New York wasn't the man I thought he was. He had two identical looking brothers. I met one of them here, Vinny Victors. Through Vinny, I learned that my ex was a horrible man. Dave did a lot of mean and cruel things. Stealing my baby was one of them."

"Dave Victors was the father of your baby?" Josh asks her.

"Yes," Savannah replies to him. "And he stole my baby. I'm guessing he set up this baby switch because he wanted to hurt Vinny and Daisy. But it's all speculation."

"What did you do when the truth finally came out?" Josh asks her next.

Savannah sighs. "I was shocked. I didn't know what to do. After all these years I found my baby," she says with tears in her eyes. "I just wanted to be with Andrew. That's all I wanted. All the years that were robbed from me … I can never get those back, but I can have the future with my son. I want that future."

"Can you explain why you started to ask Ms. Davenport for help?"

"Of course," Savannah quickly replies as she dries her eye. "Andrew was having a hard time adjusting, which is completely understandable. I knew that Trenyce could get through to him. I believed that he would continue to get better as time went on."

"Thank you Ms. Pherson. No further questions," Josh says to the Judge.

Natasha stands up and looks at Savannah. "When you dated Dave Victors, you saw no signs of his evil streak?" she asks Savannah.

"None," Savannah replies to her.

"And when Andrew came to live with you, you couldn't keep up the cleanliness of your house?"

"I was trying but it was difficult," Savannah admits to her. "I'm sure what the point of this is."

Natasha moves forward and looks at Savannah. "You clearly have trouble with judgement. From men to your home life."

"Objection!" Josh yells standing up.

"No further questions," Natasha smiles to the Judge.

"Well, you've all given me a great deal to think about," Judge Ross says to everyone in the court room. "It's very easy to see that you all care very deeply for Andrew. I'm going to take a day or two to weigh my decisions and I will call you back once I've made my decision."

He slams his mallet down. "Court's in recess," he announces to everyone, as Trenyce and Savannah slowly make eye contact with each other knowing that their futures are in someone else's hands.
